OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees are exposed to assaults by patients. Employees, including intake employees, counselors, and other staff were exposed to the hazard of physical threats and assaults, such as being kicked, bitten, punched, and physically assaulted by patients during the intake process and while providing care to patients after admission: a) At Harbor Pines, 880 Airport Blvd, Melbourne, FL 32901: On or about May 15, 2022, an intake specialist was assaulted by a patient while performing intake processing for patient admission into the facility. A second employee suffered a laceration to the head while assisting with the restraint of the patient.
