OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to acts of workplace violence caused by patients: Employees were exposed to the hazard of physical threats and assaults, such as being bitten, punched, kicked, scratched, and spit on, when interacting with patients during care and daily activities. Assaults have resulted in injuries including sprains, contusions, lacerations, fractures, and a concussion. a) On or about November 7, 2023, in the Sheridan West Unit located at 400 E. Sheridan Rd., Melbourne, FL 32901: a Mental Health Technician (MHT) was assaulted by a patient while performing monitoring activities in the facility. A second employee suffered a laceration to their hand while assisting with the restraint of the patient. Circles of Care, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1599107, citation number 1, item number 1, and was affirmed as a final order on 12/12/2022, with respect to a workplace located at 880 Airport Blvd. Melbourne, FL 32901.

The employer notified OSHA on November 9, 2023, of the in-patient hospitalization.
