29 CFR 1910.132(a):Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) Painting area back of building: The employer did not provide and ensure the use of protective suits by painters who spray painted metals using paints, including, but not limited to, Sher-Kem Dry Metal Finishing Enamel, on or about 5/23/22. b) Back of building near painting area: The employer did not provide and ensure the use of personal protective equipment for the legs and torso to protect against sparks when employees used a demolition saw to cut metal racks, on or about 5/23/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
