29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Employees were exposed to noise hazards. Employees performing mowing operations at multiple locations in Johnson County, Kansas, utilizing riding lawn mowers, weed eaters, and leaf blowers, were exposed to noise hazards in that they were exposed to a dose in excess of 85 decibels measured on the A scale and the employer did not administer a continuing, effective hearing conservation program. On June 3, 2022 employees were exposed to an 8-hour time weighted average of 94.8 decibels measured on the A-scale Permissible Exposure Limit (PEL), where noise sampling was performed for 473 minutes.
