OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the toxic and fire hazards  of anhydrous ammonia:  a) Refrigeration system at 1717 Pillsbury Street in East Greenville, PA 18041. On or about May 31,2022,and at times prior thereto,  the ammonia refrigeration system was not designed in a way to facilitate safe shutdown, wherein the emergency shut-off switch located outside of the principal machinery room  was not easily identifiable, exposing employees to potential hazards of ammonia during shutoff operations.  b) Refrigeration system at 1717 Pillsbury Street in East Greenville, PA 18041. On or about May 31,2022,and at times prior thereto,  the ammonia refrigeration system was not designed in a way to facilitate safe shutdown and evacuation, wherein ammonia alarms were not audible in the facility, potentially exposing employees to the hazards of ammonia.  c) Refrigeration system at 1717 Pillsbury Street in East Greenville, PA 18041. On or about May 31,2022, and at times prior thereto,  the ammonia refrigeration system was not designed in a way to facilitate safe and timely shutoff of the ammonia system. A valve was labeled as a king valve and did not have any manually operable element. Employer's emergency action plan identifies actuating the king valve as a step in emergency shutoff, exposing employees to potential hazards of ammonia during shutoff procedures.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
