OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from caught in & struck by hazards created by unsafe utilization of racking systems:  (b) 157 West Jackson Street, New Holland, PA, Cold Storage Room (cooler) - On or about September 1, 2022, the storage racking system was not properly anchored to the floor. Employees were exposed to crushing and struck by hazards.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.22(c): The employer did not provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces.  (a)  157 West Jackson Street, Silo 30c, interior of milk receiving area - On or about June 9, 2022, employees accessing the silo alcove to perform maintenance work had to climb over and onto pipes to access the silo alcove, employees were exposed to a fall hazard.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.23(d)(2): 29 CFR 1910.23(d)(2): The employer did not ensure that the minimum perpendicular distance from the centerline of the steps or rungs, or grab bars, or both, to the nearest permanent object in back of the ladder is 7 inches (18 cm), except for elevator pit ladders, which have a minimum perpendicular distance of 4.5 inches (11 cm).   (a) 157 West Jackson Street, New Holland, PA, building exterior next to compressor room door and yellow compressed gas storage cage - The top step of the yellow fixed ladder used for roof access with a height of approximately 13 feet is less than 7 inches away from the rain gutter. Employees are exposed to fall hazards.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times:   (a) 157 West Jackson Street, New Holland PA, interior of the milk receiving area, above Silo 30c alcove, - On or about June 9, 2022, the emergency lighting at Silo 30c was not in proper working order at all times, including at the time of inspection. Employees were exposed to fire and smoke inhalation hazards due to the emergency lighting not being in working order.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tank cars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:  (a)  157 West Jackson Street, New Holland PA, fenced in area next to compressor room door - On or about June 9, 2022 two compressed gas cylinders were stored without the protective caps in place.   Abatement certification required within 10 days after abatement date.
