OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious harm in that employees were exposed to inhalation hazards from anhydrous ammonia. a) 158 W. Jackson Street, New Holland, PA - On or about June 9, 2022, an alarm system was not functioning. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.119(h)(3)(ii): The contract employer did not assure that each contract employee was instructed in the known fire, explosion, or toxic release hazards related to his/her job and the process, and the applicable provisions of the emergency action plan. a. 157 W. Jackson Road, New Holland, PA - On or about May 31, 2022, the employer failed to ensure that their employees were instructed on the hazards of a toxic release of anhydrous ammonia and the emergency action plan developed by the processes at Advanced Food Products, to include recognition of ammonia alarms and where to shelter or evacuate to and in what circumstances that require specific actions. Failure to provide and communicate training on the host companies AEP and hazards of their system exposed employees to anhydrous ammonia during the ammonia release on May 31, 2022. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
