29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. On or about June 8th, 2022, and at times prior thereto and thereafter, refresher training and evaluation was not provided to an operator involved in an incident, exposing employees to crushed by and/or struck by hazards.

29 CFR 1910.179(l)(2)(i)(d): Where cranes were inoperable, warning or "out of order" signs were not placed placed on the crane, also on the floor beneath or on the hook where visible from the floor. On or about June 9th, 2022, and at times prior thereto, employees worked near an inoperable crane that did not contain the proper warning signs that the crane was out of order, exposing employees to struck by hazards.
