OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about July 17, 2014, and times prior thereto, paint line, a Yale forklift was being used to elevate employees in a work platform with a width greater than the overall width of the truck (measured across the load bearing tires) plus 10 inches on either side. Employees were exposed to the hazard of falls and/or being struck by the falling basket.
