29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Advanced Roofing Systems, LLC at 4580 Highway 16, Rapid City, SD 57702: On or about and at times prior to June 11, 2022, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a commercial property without the use of a fall protection system and ladder hazards on site. This condition exposed employees to fall hazards of greater than six feet.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on high-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail systems, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system: (a)Advanced Roofing Systems, LLC at 4580 Highway 16, Rapid City, SD 57702: On or about and at times prior to June 11, 2022, the employer did not ensure that employees were protected from falls while conducting roofing operations on a commercial roof. This condition exposed the employees to fall hazards greater than six feet. Advanced Roofing Systems, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1513272, citation number 1, item number 1, and was affirmed as a final order on March 2, 2021, with respect to a workplace located at 402 2nd Street, Rapid City, SD 57701.

29 CFR 1926.1053(b)(1): A portable ladder was used for access to an upper landing, and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing, and was not secured: (a) Advanced Roofing Systems, LLC at 4580 Highway 16, Rapid City, SD 57702: On or about and at times prior to June 11, 2022, the employer did not ensure that the ladder the employees were using was extended at least three feet above the upper landing surface of the edge of the commercial roof. This condition exposed employees to fall hazards of approximately 15 feet from the roof to the ground. Advanced Roofing Systems, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1513272, citation number 1, item number 2 and was affirmed as a final order on March 2, 2021, with respect to a workplace located at 402 2nd Street, Rapid City, SD 57701.
