29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition, the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. (a) On or about June 13, 2021, at a job site located South of Highway 50 (75th St.) Kenosha, WI., employees who were exposed to cave-in, engulfment, and struck-by hazards while conducting drainage pipe removal work in and around a trench that was not properly protected. The employees were not removed from this hazard by the competent person on site. (b) On or about June 13, 2021, at a job site located South of Highway 50 (75th St.) Kenosha, WI., employees who were using the unprotected trench wall as a means of egress. This exposed employees to a cave-in, and engulfment Hazard. The employee was not removed from this hazard by the competent person on site.

29 CFR 1926.652(b)(1)(i) Excavations shall be sloped at an angle not steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal), unless the employer uses one of the other options listed below. (a) On or about June 13, 2022,t a job site located South of Highway 50 (75th St.) Kenosha, WI., employees worked in an approximately ten (10) foot deep trench, involved in activities to include removal of drainage pipe in preparation for new pipe installation without cave-in protection. This exposed employees to struck-by, crushing and engulfment hazards.
