29 CFR 1926.651(k)(1) Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  (a) On or about June 7, 2024, at a jobsite located at  or near 7897 88th Ave, Pleasant Prairie, WI 53158, employees were not removed by the competent person when exposed to cave-in and struck-by hazards that existed while the employees were conducting water main installation work in an excavation that was approximately seven (7) to 10 feet deep and was not properly protected from cave-in.  D K Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard29 CFR 1926.651(k)(2), which was contained in OSHA inspection number_1602105, citation number 1, item number1, and was affirmed as a final order on 12/1/2022, with respect to a workplace located at5671 75th St. Kenosha, WI. 53140.
