29 CFR  1910.30(a)(3)(iv):  The employer did not train each employee in the correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer:   Warehouse:  On, or about, June 13, 2022, the company had not provided adequate training to an employee who used personal fall arrest equipment while selection orders from an "operator up" Toyota forktruck.  The employee was not wearing a Miller H100 body harness correctly.

29 CFR  1910.140(d)(1)(ii):  The employer did not ensure that fall protection systems bring employees to a complete stop and limit the maximum deceleration distance the employee travels to 3.5 feet (1.1m):  Warehouse:  On, or about, June 13, 2022, an employee who selected orders from elevated storage rack bays was provided with a Miller Scorpion Personal Fall Limiter (PFL) that was rated for a capacity of 310 pounds.  The weight limit of the device was not sufficient for the employee's stated weight which could have caused a failure of the braking system in the PFL and allowed the lanyard webbing to deploy the entire nine foot length in the event of a fall.

29 CFR 1910.140(d)(1)(iv):  The employer did not ensure that fall protection systems sustain the employee within the system/strap configuration without making contact with the employee's neck and chin area:  Warehouse:  On, or about, June 13, 2022, an employee who selected orders from elevated storage rack bays wore personal fall arrest equipment including a harness.  The leg straps on the harness were not fastened in place, which could have caused the chest strap to contact his neck/chin in the event of a fall.

29 CFR  1910.151(c):  Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  Warehouse:  On, or about, June 13, 2022, the two self-contained eyewash units provided for forktruck battery maintenance were not available for ready use in that:  A. Battery Charging Area:  The solution in the self-contained eyewash unit was not changed every six months as recommended by the manufacturer.  The solution had last been changed in October, 2019.  B.  Battery Filling Area:  The solution in the self-contained eyewash unit was not changed every six months as recommended by the  manufacturer.  The unit had not been provided with a maintenance tag to show the date of the last refill, but the solution was older than six months.

Abatement Note:  The switch itself was broken and should be replaced.
