29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition, the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. (a) On or about June 14, 2021, at a job site located South of 75th St., Kenosha, WI., employees were exposed to cave-in and struck-by hazards while conducting pipe installation work in a trench that was not properly shielded or otherwise protected from cave-in hazards. (b) On or about June 14, 2021, at a job site located South of 75th St , Kenosha, WI., asphalt road above and adjacent to the excavation was undermined, and not effectively supported, creating a cave-in hazard and struck by hazard. (c) On or about June 14, 2021, at a job site located South of 75th St., Kenosha, WI., The employer did not remove employees from the hazardous conditions when adaquate means of egress were not provided to allow employees a safe exit in the case of an cave-in or other hazardous situation.

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: (a) On or about June 14, 2022, at a drainage pipe installation jobsite located on the South side of 75th St. Kenosha, WI., employees working in and around the 10 foot deep, trench excavation were exposed to struck by, crushing and fall hazards associated with undermined portions of the asphalt road directly adjacent to the West side of the excavation.
