Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: (a)Ruiz Construction at 6000 West 43rd Street, Sioux Falls, SD 57106: On or about and at times prior to June 23, 2022, the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a low-slope commercial property. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). (a)Ruiz Construction at 6000 West 43rd Street, Sioux Falls, SD 57106: On or about and at times prior to June 23, 2022, the employer did not ensure that each powered industrial truck operator was competent to operate the JCB Model 512.56 F Telehandler safely, as demonstrated by the successful completion of a forklift training and evaluation program. This condition exposed employees to struck-by hazards associated with improper use and operation.
