29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On or about June 28, 2022, at jobsite located in 531 Vine St., Hinsdale, IL., 60521, employees were exposed to fall hazards in excess of 18 feet while engaged in residential roofing activities. Fall protection was not being utilized while performing roofing activities. The employees were wearing a harness but not tied-off to lifeline lanyard. No abatement certification or documentation is required for this item.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On June 28, 2022, employees were not wearing a protective helmet where there was a possible danger of head injury from falling objects. Employees were throwing roofing materials off a residential roof onto the ground level, exposing the employees to struck-by hazards from falling objects. Employees in ground level were not wearing a safety hard hat. No abatement certification or documentation is required for this item. The N Castro Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.100(a) , which was contained in OSHA inspection number 1518654 citation number 1, item number 1 and was affirmed as a final order on May 3, 2021, with respect to a workplace located at 714 Tullamore CT., Schaumburg, IL 60193.
