1910.212(a)(3)(ii) The point of operation of machines whose operation exposed an employee to injury, was not guarded: 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) On and before June 29, 2022, the employer did not provide one or more methods of machine guarding to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, and flying chips and sparks, in that employees in the maintenance shop were required to use a Palmgren 15" Metal/Wood Cutting Band Saw that had a non-operational guard on the blade. This condition exposed employees to injuries including, but not limited to, lacerations and amputations. (b) On and before June 29, 2022, the employer did not provide one or more methods of machine guarding to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, and flying chips and sparks, in that employees in the maintenance shop were required to use a JET Equipment & Tools Belt Drive Bench Lathe without a guard installed. This condition exposed employees to injuries including, but not limited to, lacerations and amputations.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: (a) On and before June 29, 2022, the employer did not provide suitable facilities for quick drenching or flushing of the eyes and body within the work area for immediate emergency use, in that employees cleaning with ENFORCE LP in the processing unit did not have access to an emergency eye/body wash station. This condition exposes employees to skin and eye injuries associated with a Category 1 substance.
