29 CFR 1910.120(q)(6)(ii): First responders at the operational level did not receive at least eight hours of training or did not have sufficient experience to objectively demonstrate competency in the areas required by 29 CFR 1910.120(q)(6)(ii)(A) through (q)(6)(ii)(F) and/or the employer did not so certify: A.) American Turned Products, Inc., utilities area, on or about July 1, 2022: Employees who had not received training at the First Responders Operations Level participated in emergency response activities following the transfer of a Sulfuric acid waste solution into a tote which contained residual machining waste fluids. Employees engaged in defensive response actions in an attempt to stop the chemical reaction, including adding water to the tote where the reaction was occurring, and moving the tote outside of the building with a forklift. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

American Turned Products, Inc., on or about July 1st, 2022: The Cecor Vacuum system was improperly used to transfer a waste sulfuric acid solution to a tote, and during the attempts to control the chemical reaction caused by the mixed liquids in the tote. The Cecor Vacuum listing and labeling states it is not to be used with corrosives. American Turned Products, Inc., on or about July 1, 2022: employees worked with and around hazardous substances including but not limited to sulfuric acid, and machining oils. Prior to initiating a hazardous substance liquid transfer operation from a drum to a tote using a vacuum, the employer did not conduct Hazard Communication training with employees. A Sulfuric acid waste solution was transferred to a tote which contained residual machining waste fluids. The mixture resulted in a chemical reaction and the employees were engaged in emergency response actions. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
