Located at 4122 Big Run South Rd., GROVE CITY, OH 43123:  a. On or about July 7, 2022, and at times prior, the employer failed to maintain a safety and health program to ensure hazard detection and correction including, but not limited to, electrical safety, fall protection, ladder safety, powered industrial vehicle safety, and personal protective equipment, thereby exposing employees to fall and struck-by hazards.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  Located at 4122 Big Run South Rd., GROVE CITY, OH 43123:  a. On or about July 7, 2022, and at times prior, the employer failed to instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize hazards associated with residential framing work. Employees were not trained on subjects such as, but not limited to, electrical safety, fall prevention/protection, ladder safety, personal protective equipment and PIV safety.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  Located at 4122 Big Run South Rd., GROVE CITY, OH 43123:  a. On or about July 7, 2022, the employer did not ensure that employees utilized eye protection while utilizing pneumatic nail guns to frame the residential structure being built, thereby exposing employees to struck-by hazards.  b. On or about July 7, 2022, the employer did not ensure that employees utilized eye protection while utilizing portable circular saws to cut framing materials to size for the residential structure being built, thereby exposing employees to struck-by hazards.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  Located at 4122 Big Run South Rd., GROVE CITY, OH 43123:  a. On or about July 7, 2022, employees were observed working at the unprotected edges of the second story floor trusses while installing floor trusses and erecting the exterior wall at a new-build residential home. As a result, employees were exposed to fall hazards of up to approximately 14 feet.  b. On or about July 7, 2022, an employee was observed working at the unprotected edge of the second story floor trusses at the front of the house to install the first story porch wooden beam at a new-build residential home. As a result, the employee was exposed to a fall hazard of approximately 10 feet.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  Located at 4122 Big Run South Rd., GROVE CITY, OH 43123:  a. On or about July 7, 2022, the employer did not ensure that the Gorilla multi-positional portable ladder that was utilized for access to the second story of the new build residential structure being framed was extended at least 3 feet above the upper landing surface, thereby exposing employees to fall hazards of approximately 10 feet.
