29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   (a) On and prior to July 7, 2022, at Lot 1347, Cottages at Northlake, Sunbury, OH 43074, Osorios Construction LLC employees were walking and working on an under-construction roof at heights of and exceeding approximately 12'6" using improperly-adjusted personal fall arrest systems (PFAS). PFAS were configured so that the total length of slack in the lifeline exceeded the safe free fall/lower level contact distance, which exposed employees to fall hazards in excess of 12'.  Employees could not articulate an understanding of fall protection and prevention deficiencies on site.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   (a) On and prior to July 7, 2022,  at Lot 1347, Cottages at Northlake, Sunbury, OH 43074, Osorios Construction LLC employees were walking and working on an under-construction roof at heights of and exceeding approximately 12'6" using improperly-adjusted personal fall arrest systems (PFAS).  PFAS were configured so that the total length of slack in the lifeline exceeded the safe free fall/lower level contact distance, which exposed employees to fall hazards in excess of 12'.  An employee worked in plain view of supervisor without eye protection while using pneumatic nail gun.  The on-site supervisor did not articulate an understanding of the deficiencies in the PFAS set-up and eye protection requirements.

29 CFR  1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:   (a) On and prior to July 7, 2022,  at Lot 1347, Cottages at Northlake, Sunbury, OH 43074, Osorios Construction LLC employees were walking and working on an under-construction roof at heights of and exceeding approximately 12'6" using improperly-adjusted personal fall arrest systems (PFAS), which exposed employees to fall hazards in excess of 12', and using pneumatic nail guns without eye protection, which exposed employees to struck-by hazards.  The on-site supervisor did not articulate nor provide evidence of an accident prevention program.  Osorios Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1591313, citation number 1, item number 1 and was affirmed as a final order on 13 June 2022, with respect to a workplace located at 20 Erin Hills Road, Lot 114, Commercial Point, OH 43116.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) On and prior to July 7, 2022, at Lot 1347, Cottages at Northlake, Sunbury, OH 43074, Osorios Construction LLC failed to ensure that the affected employee used appropriate eye protection when exposed to eye hazards from flying particles while operating a pneumatic nail gun.  The employee was using a pneumatic nail gun to attach roof shingles without any eye protection, which exposed him to struck-by hazards from flying particles.  Osorios Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR  1926.102(a)(1), which was contained in OSHA inspection number 1591313, citation number 1, item number 2 and was affirmed as a final order on 13 June 2022, with respect to a workplace located at 20 Erin Hills Road, Lot 114, Commercial Point, OH 43116.

29 CFR  1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:   (a) On and prior to July 7, 2022, at Lot 1347, Cottages at Northlake, Sunbury, OH 43074, Osorios Construction LLC failed to ensure that personal fall arrest systems were rigged such that an employee could not free fall more than 6 feet nor contact any lower level.  CSHOs observed Osorio walking and working on an under-construction roof at a height of and exceeding approximately 12'6" using an improperly-adjusted personal fall arrest system (PFAS).  Osorio was walking across the roof with his PFAS improperly adjusted, so that the total length of slack in the lifeline exceeded the safe free fall/lower level contact distance, which exposed him to fall hazards in excess of 12'.  Osorios Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR  1926.502(d)(16)(iii), which was contained in OSHA inspection number 1591313, citation number 2, item number 1-b and was affirmed as a final order on 13 June 2022, with respect to a workplace located at 20 Erin Hills Road, Lot 114, Commercial Point, OH 43116.  Osorios Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR  1926.502(d)(16)(iii), which was contained in OSHA inspection number 1390338, citation number 1, item number 1-b and was affirmed as a final order on 11 April 2019, with respect to a workplace located at 618 Ludham Trail, Lot 178, Pickerington, OH 43147.
