OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high ambient heat while performing jobs duties:  On or about and at times prior to July 8, 2022, employees were exposed to the hazard of high ambient heat from the direct sunlight during the performance of their job duties, including carrying a roll of portable pipe, rolling it out which involved bending and pushing.  National Oceanic and Atmospheric Administration (NOAA) station in Stuttgart showed a temperature of 89 degrees Fahrenheit at the time of the incident with a relative humidity of 68% at the time of 8:56 AM approximately the same time as the incident. The calculated heat index for the time was approximately 102 degrees Fahrenheit. NOAA recommends extreme caution be used when working in conditions similar to the one the victim was working in.  Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.  The victim complained to witnesses that he was uncomfortable and hot and was observed vomiting.

29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, a person or persons were not adequately trained to render First Aid.  On or about July 8, 2022, employees at a dry bed outside the hunting lodge were preparing a field to be flooded. The employees were approximately 30 minutes by car to the nearest hospital.
