29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. A.) On July 12, 2022, maintenance employees were not trained in the safe operation of powered industrial vehicles by means of formal classroom instruction and practical training.

Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. -(i)(A) Operating instructions, warnings, and precautions for the types of truck the operator will be authorized to operate; A.) On July 12, 2022, the employer did not ensure that maintenance employees operating the JLG rough terrain forklift were trained in operating instructions such as but not limited to; lowering the forks upon exit of the rough terrain forklift.

29 CFR 1910.178(m)(5)(i):When a powered industrial truck is left unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shall be shut off, and brakes set. Wheels shall be blocked if the truck is parked on an incline. A.) On July 12, 2022, the JLG rough terrain forklift was parked outside of bay #7 of the mechanic's shop with the forks in a raised position. On July 13, 2022, employees that were driving by the forks of the JLG rough terrain forklift were exposed to struck by hazard.
