29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about July 15, 2022, An audiometric testing program was not established and maintained by making audiometric testing available for instances such as, but not limited to employees building sheds with saws and pneumatic nail guns in the south building: a. On or about July 15, 2022, employee building shed in the South Building was exposed to 97.92 percent dose of the permissible daily dose, as measured over 403 minutes of sampling. The does is equivalent to an 8 hour time weighted average of 89.84 dBA, accounting for the period of 77 minutes unmonitored. b. On or about July 15, 2022, employee building shed in the South Building was exposed to 79.76 percent dose of the permissible daily dose, as measured over 436 minutes of sampling. The does is equivalent to an 8 hour time weighted average of 88.37 dBA, accounting for the period of 77 minutes unmonitored.
