29 CFR 1926.1427(a)(1): Operation during training. An employee who has not been certified/licensed and evaluated to operate assigned equipment in accordance with this section operated the equipment as an operator-in-training not under supervision in accordance with the requirements of paragraph (b) of this section. On or about July 20, 2022, on the east side of the site, an operator in training was actively performing a lift of an A/C unit without the qualified trainer on-site supervising the trainee or a written plan for the trainee to follow. This exposed employees to struck-by hazards.

29 CFR 1926.1427(b)(2): The trainer did not continuously monitor the on-site operator-in-training while operating equipment. On or about July 20, 2022, On the east side of the site, an operator in training was actively performing a lift of an A/C unit without a qualified trainer on-site supervising the trainee. As a result, the foreman/trainer ceased observation duties of the crane operator-in-training while the trainee continued to engage in crane operations, exposing employees to struck-by hazards.
