29 CFR  1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or before 7/21/2022, and times prior, the employer failed to conduct a hazard assessment of the workplace where employees perform work practice such as: fabrication of metal, cutting with bandsaw, Welding of metal parts, as well as painting metal beams. During interviews with Director of Safety, Marty Blackston, He revealed that an assessment was not done of the workplace.

29 CFR  1910.147(c)(1):Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  a) Metal fabrication and construction facility, interior: on about 7/21/2022, and at times prior, , the employer exposed employees to physical hazards, in that the employer did not develop and implement a control of hazardous energy program for employees who conduct service and maintenance on iron cutting bandsaw.

29 CFR  1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.    (a) Metal fabrication and construction facility, interior: on about 7/21/2022, and at times prior, , the employer exposed employees to physical hazards, in that the Grizzly G0592 Iron cutting bandsaw is unguarded at the point of operation, exposing employees to amputation hazards. Employees use the iron cutting bandsaw to cut metal beams in the steel side shop.

29 CFR  1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.)   29 CFR  1910.215(a)(4): Work rests. On offhand grinding machines, work rests shall be used to support the work. They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. The work rest shall be securely clamped after each adjustment. The adjustment shall not be made with the wheel in motion.     a) Steel Side Production Line: On or about 7/21/2022, and at times prior, the employer exposed employees to struck-by hazards, in that there were no guards in place on the Ryobi BG612G bench grinder. Employees use the grinder to sharpen metal blades and shape metal pieces of materials in the steel shop.

29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by guardrail system, safety net system or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.  a) SHJ Construction, Steel side: On or about 7/21/2022, and times prior, the employer exposed employees to fall hazards, in that the employer  failed to provide fall protection system or guardrail to unprotected side of dock area where employees move metal beams for car wash kit, from interior of facility to outside of the facility, to be painted or stained.
