29 CFR 1926.1052(c)(4)(i): Midrails used in stairrail systems were not located at a height midway between the top edge of the stairrail system and the stairway steps: Location: front stairway between 1st and 2nd floor On or about: 7/14/22 a) Employees, engaged in plumbing work, were using the front stairway for access throughout the building. The midrail was only 3 to 9 inches above the stairs. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
