29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  Employees engaged in machining and welding activities at shops #1, #2, and welding room are exposed to health hazards when using chemicals in that a written Hazardous Communication Program had not been developed and implemented in the following instances:  1. Welding stations utilizing compressed argon gas as a shielding gas was found: within the welding room, stored near entrance to old shop (shop #1), and in the northwest corner of the old shop (shop #1) within a welding area. Exposure to compressed argon gas could result in burns or frostbite and suffocation from lack of oxygen and suffocation at very high concentrations.  2. Metal machining lathes and milling machines utilizing Blaser Swisslube fluid as metalworking fluid was found within the Hardinge machines in the old and new shops (shops #1 and #2). Exposure to Blaser Swisslube fluid could result in serious eye irritation.  3. Metal machining lathes and milling machines utilizing Mobil Vactra oil  as machine lubricant was found within the Hardinge machines in the old and new shops (shops #1 and #2). Exposure to Mobil Vactra oil could result in serious skin dryness or cracking, dermatitis, and serious eye, nose, or throat irritation. If ingested, material may be aspirated into the lungs and cause chemical pneumonitis.  4. Solvent rinse station for manufactured metal cleaning that is utilizing Safety-Kleen Premium solvent was found near the entrance to the new shop (shop #2) in the northeast corner of the old shop (shop #2). Exposure to Safety-Kleen premium solvent could result in serious eye, skin, and respiratory irritation. If inhaled, respiratory irritation, nausea, loss of appetite, headache, drowsiness, dizziness, disorientation, tremors, lung damage, convulsions, coma and death could result. If ingested, drowsiness or dizziness, headache, loss of coordination, aspiration hazard could result.  Delayed affects could result in damage to central nervous system.

29 CFR  1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  Employees engaged in welding and machining activities were exposed to health hazards in that they were not provided access to Safety Data Sheets (SDSs) on hazardous chemicals at the welding/machining shop in the following instances:  1. 29 CFR  1910.132(d)(2):The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed, and the date the hazard assessment was done:  At shop #1, shop #2 and welding room employees are engaged in welding/machining activities and the employer did not certify in writing that a hazard assessment was completed. Employees were provided personal protective equipment to include earplugs, nitrile gloves and safety glasses.
