29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. On or about August 3, 2022, at the 22-56 Moran Property Retrofit Roof Over Dream Green Shredder Bldgs., the employer did not ensure employees were protected from falls where the soft roof top surface had not been strengthened. Employees were exposed to a fall hazard of at least twenty-five feet to ground or concrete below.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On or about August 3, 2022, at the 22-56 Moran Property Retrofit Roof Over Dream Green Shredder Bldgs., the employer did not ensure fall protection was installed and fall protection equipment was used prior to allowing employees to work from the roof surface. Employees were exposed to a fall hazard of at least twenty-five feet to ground or concrete below.

29 CFR 1926.502(f)(1)(i): When mechanical equipment is not being used, the warning line shall be erected not less than 6 feet (1.8 m) from the roof edge. On or about August 3, 2022, and at times prior thereto, at the 22-56 Moran Property Retrofit Roof project and the Dream Green Shredder Bldgs., the employer did not ensure employees were protected from falls by requiring the warning line to be erected at the minimum of six feet from the roofs edge to warn employees of fall hazards and the need for personal fall protection. Employees were exposed to a fall hazard of at least twenty-five feet to ground or concrete below.
