29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about August 10, 2022, the employer failed to develop and implement a written hazard communication program when employees on plating lines and the waste water treatment area of the facility were exposed to chemicals including, but not limited to, hydrochloric acid, sulfuric acid, sodium hydroxide, cadmium, zinc, sodium cyanide, and chromates. The employer failed to provide effective information and training to employees on the hazardous chemicals in their work area, and failed to ensure that each container of hazardous chemicals in the workplace was labeled.

29 CFR  1910.1200(f)(6):The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section:  On or about August 10, 2022, the employer failed to ensure that tanks of chemicals on Zinc Line 1, Zinc Line 5, and Cadmium Line, including zinc baths and cadmium baths, acid rinses, alkaline cleaners, and chromate dips were labeled with the information contained in paragraphs (f)(6)(i) through (ii) of this section. The labels that were in place did not include signal words, hazard statements, pictograms, precautionary statements or words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about August 10, 2022, where employees on the plating lines and in the waste water treatment area of the facility work with and around hazardous chemicals including, but not limited to, hydrochloric acid, sulfuric acid, sodium hydroxide, cadmium, zinc, sodium cyanide, and chromates, the employer did not ensure that employees were  provided effective information and training on hazardous chemicals in their work area.

29 CFR  1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  On or about August 10, 2022, the employer failed to provide suitable facilities for flushing of the eyes and body to employees exposed to injurious corrosive materials such as sulfuric acid, hydrochloric acid, and alkaline cleaner when the eye wash stations provided had limited flow pressure, obstructed travel paths, were not within 10 seconds of travel of each hazard, and were not identified with  highly visible signs.
