29 CFR 1910.132(a):Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) Pyrotecnico Fireworks, Inc. at the display site located at 700 County Road 1102 Ashland, Ohio. On or about August 6, 2022 the employer did not ensure employees engaged in setup operations of a fireworks display were wearing 100% cotton clothing to prevent static electricity buildup. Employees attaching friction and static sensitive electric igniters to quick fuses on firework shells were exposed to hazards associated with the premature detonation of the firework in that the employees did not wear personal protective equipment to prevent the accumulation and discharge of static electricity.

On or about August 6, 2022, the required workplace hazard assessment did not include a written certification that identified the person certifying the workplace and evaluation and date of the hazard assessment. Employees attaching friction and static sensitive electric igniters to quick fuses on firework shells were exposed to hazards associated with the premature detonation of the firework in that the employees did not wear personal protective equipment to prevent the accumulation and discharge of static electricity.

29 CFR 1910.132(f)(1):The employer did not provide training to each employee who is required by this section to use personal protective equipment: a) Pyrotecnico Fireworks, Inc. at the display site located at 700 County Road 1102 Ashland, Ohio. On or about August 6, 2022 the employer did not ensure employees were trained to know when and what personal protective equipment is necessary when setting up firework displays. Employees attaching friction and static sensitive electric igniters to quick fuses on firework shells were exposed to hazards associated with the premature detonation of the firework in that the employees were not aware that personal protective equipment to prevent the accumulation and discharge of static electricity, such as, but not limited to static dissipated clothing and conductive shoes, were required.
