29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment: Location: New Seabury Country Club On or about July 2, 2025, employees were exposed to burn hazards while setting up commercial pyrotechnics display where the employer failed to conduct an assessment of the hazards associated with the setup of a fireworks display using electronic matches, to determine what personal protective equipment would be required to protect employees from the associated hazards. Not all employees working on site wore long pants or long sleeves. One employee suffered burns to his left hand, left knee, and right leg, as well as shrapnel wounds. The Pyrotecnico Fireworks Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.132(d)(2), which was contained in OSHA inspection number 1613668, citation number 1, item number 2A and was affirmed as a final order on 3/1/2023, with respect to a workplace located at 700 Country Road 1102, Ashland, OH 44805.
