29 CFR 1910.119(e)(5): The employer did not establish a system to promptly address the team's findings and recommendations; assure that the recommendations are resolved in a timely manner and that the resolution is documented; document what actions are to be taken; complete actions as soon as possible; develop a written schedule of when these actions are to be completed; communicate the actions to operating, maintenance and other employees whose work assignments are in the process and who may be affected by the recommendations or actions. On or about August 9, 2022, employees were potentially exposed to fire, explosion and toxic gas release hazards when the employer did not resolve 2013 HF Alkylation PHA recommendations in a timely manner, including but not limited to: Item 1. Upgrade Pump to API standard, install tandem seal on Charge Booster Pump 11P-034, Consider spare pump. (Deviation 2 Low/No Flow). Item 2. Installing PSV rated for 150 # on Butane Cooler E-021 for blocked outlet. (Deviation 11 High Pressure). Item 3. Evaluate installation of PRV on Prefrac Receiver 11D-010. (Deviation 3 High Temp on 11D-010) Item 4. Evaluate PRV to vent to flare and not atmosphere for Deisobutanizer T-017. (Deviation 4 Low level in Deiso Receiver). Item 5. Relocate PSV Vent Line for Horizontal Condensate Drum D-020 and Condensate Surge Drum D-029. (Deviation 16 PSVs vents to unsafe locations).

29 CFR 1910.119(f)(4): The employer did not implement safe work practices to provide for the control of hazards during operations such as lockout/tagout; confined space entry; opening process equipment or piping; and control over entrance into a facility by maintenance, contractor, laboratory, or other support personnel. These safe work practices shall apply to employees and contractor employees. On or about August 9, 2022, employees were exposed to fire, explosion and toxic gas release hazards when the employer did not implement safe work practices to ensure all valves, sample points, pipe, pipe connections, etc. in hydrocarbon service shall be plugged, capped or blinded under normal operating conditions for Hot Oil Heat Exchanger (E-033) in the HF Alkylation Unit per Section 5.1 Bleeder Valves and Process Valves of Blinding Procedure 207.2.

29 CFR 1910.119(d)(3): Information pertaining to the equipment in the process. On or about August 9, 2022, the employer did not ensure that written process safety information for equipment in the process included the documentation of appropriate responses to inspector recommendations related to CML placement for the HF Alky Depropanizer Column T-011. The Employer will develop and implement its Deficiency Resolution for Fixed Equipment procedure which will include instructions and requirements for documenting rejected inspection recommendations. The employer will ensure that the BSR Fixed Equipment Inspection Team receive training on this procedure. Abatement due date will be 30 April 2023 and the employer will submit verification of abatement within 10 calendar days of the abatement due date.
