29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations: (a)H & W Contracting, L.L.C. at 217 East 6th Avenue, Redfield, SD 57469: On or about and at times prior to August 11, 2022, the employer did not ensure that employees were protected from injury in that the spoils pile on the southwestern wall of the trench was not placed at least two feet from the trench to prevent material from rolling into the excavation. This condition exposed employees to struck-by and cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c): (a)H & W Contracting, L.L.C. at 217 East 6th Avenue, Redfield, SD 57469: On or about and at times prior to August 11, 2022, the employer did not ensure that employees were protected from cave-in hazards while working within an unprotected excavation that measured greater than five feet in depth. This condition exposed employees to cave-in and struck-by hazards associated with excavation wall collapse. H & W Contracting, L.L.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1565208, citation number 1, item number 1a and was affirmed as a final order on May 25, 2022, with respect to a workplace located at Main Street & Washington Avenue, Salem, SD 57058. H & W Contracting, L.L.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1564024, citation number 2, item number 1 and was affirmed as a final order on May 25, 2022, with respect to a workplace located at 271st Street and Kerslake Place, Tea, SD 57064. This condition exposed employees to cave-in hazards associated with trench wall failure. H & W Contracting, L.L.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 1564024, citation number 1, item number 2 and was affirmed as a final order on May 25, 2022, with respect to a workplace located at 271st Street and Kerslake Place, Tea, SD 57064.
