29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about August 15, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914, one employee was performing residential roofing activities with a fall hazard of eight feet nine inches and did not attach their fall arrest components to a point near the center of their back.  b. On or about August 15, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914, employees were performing residential roofing activities while having multiple lanyard tied into the same anchor point.  c. On or about August 12, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914, employees were performing residential roofing activities without any form of conventional fall protection or not proper wearing fall protection while exposed to falls that ranged from approximately eight feet five inches to 18 feet.   d. On or about August 11, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914, employees were performing residential roofing activities without any form of conventional fall protection or not proper wearing fall protection while exposed to falls that ranged from approximately eight feet five inches to 18 feet.  e. On or about August 10, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914, employees were performing residential roofing activities without any form of conventional fall protection or not proper wearing fall protection while exposed to falls that ranged from approximately eight feet five inches to 18 feet.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.

29 CFR  1926.502(d)(15):Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  On or about August 15, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914, four employees was performing residential roofing activities while being tied into one anchor point with multiple lanyards.   Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about August 12, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914: employees were utilizing a metal extension ladder and were exposed to a fall hazard of approximately eight feet three inches, as the ladder used for accessing and egressing the roof did not extend three feet above the roof edge.

29 CFR  1926.1053(b)(5)(i):Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  On or about August 12, 2022, at a worksite located at 1509 N. Lilas Drive Appleton, WI 54914: the horizontal distance from the vertical support to the base of the extension ladder which was used by the employees to access a roof was more than one fourth (1/4) the working length of the ladder.
