29 CFR  1903.19(d)(1):  The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer failed to submit documentation of abatement within 10 days of the abatement date for Citation 1 Item 1.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer did not demonstrate that it is infeasible or creates a greater hazard to use these systems.  On August 16, 2022, two employees were installing shingles on the roof of a three story residential apartment building at a height greater than six feet above lower levels and were not protected from falls by guardrail systems, safety net systems, personal fall arrest system, or other alternative fall protection measures under another provision of paragraph 1926.501 (b) such as a safety monitoring system.    Arturo Melchor DBA Melchor Windows and Siding, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1287114, citation number 1, item number 2 and was affirmed as a final order on February 16, 2018, with respect to a workplace located at 131 Camelot Circle, Oregon, WI 53575.
