29 CFR 1926.652(e)(2)(i):Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of a support system was permitted where the system was not designed to resist the forces calculated for the full depth of the trench: (a) On or about August 16, 2022 at or near 116 North Fourth Street in Bismarck, North Dakota, for the employees exposed to cave in hazards while installing water services in a trench of approximately 7 feet 7 inches in depth where the trench shield was approximately 3 feet above the bottom of the trench.
