29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.   a)	MAM Construction LLC. On or about August 17, 2022, at the address of 1626 Tuscan Lane, Avon Lake OH 44012: The employer did not ensure employees using aluminum ladders had their side rails extended at least three feet above the landing surface. One employee was exposed to fall hazards while using ladders to access the first level of a multifamily two-story residential structure with a height of 10 feet from ground below.

On or about August 17, 2022, at the address of 1626 Tuscan Lane, Avon Lake OH 44012: The employer did not ensure that employee(s) avoided working from the top two rungs/steps of the 6-foot stepladder positioned atop the second level of a residential new construction multifamily home. Employee(s) using ladder in this condition were exposed to approximately 6 feet or greater fall hazard due to the improper use of the ladder.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)	MAM Construction LLC. On or about August 17, 2022, at the address of 1626 Tuscan Lane, Avon Lake OH 44012: The employer did not ensure employees were protected from falls while performing framing activities atop a two-story multifamily residential structure. Employees operating in this conditions were exposed to falls of 19 feet or greater to the ground below.   MAM Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1262959, citation number 1, item number 2 and was affirmed as a final order on October 10, 2017, with respect to a workplace located at 308 Woodside Lane, Tallmadge OH 44278.
