29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. a. On or about August 24, 2022, at the above addressed jobsite, employees conducting carpentry operations, greater than eleven (11) feet nine (9) inches above the ground, were not protected from falling, thereby exposing the employees to fall hazards. COUNSEL CONSTRUCTION, LLC was previously cited for its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1449344, citation number1, item number 1 and was affirmed as a final order on February 25, 2020, with respect to a workplace located at 3116 S. RT 59, in NAPERVILLE, IL 60564.

On or about August 24, 2022, at the above addressed jobsite, employees had been provided fall training, however, the employer failed to keep a written certification record of the training.
