OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of struck-by while moving rail cars across multiple yard lines (sidings):  a) On or about August 25, 2022, in the storage yard area, employees were exposed to struck-by hazards from railcars moving on yard lines during coupling and shoving operations.  Among other methods, an acceptable means of abatement includes, but is not limited to:  a) Ensure employees are in a safe position at all times. b) Utilize the Watco Switching Rail Training Policy which accounts for an employee's experience level, through a checklist, as that employee progresses through training. c) Ensure all persons and equipment remain clear of the tracks during movements to include shoving movements.
