29 CFR 1910.22(d)(1): Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition; a.) On or about August 23, 2022, the employer did not ensure that depot yard potholes located to the northwest of the bridge that measured approximately (1) 4 inches deep and 24 feet long x 22 feet wide, (2) 4 inches deep and 24 feet long x 24 feet wide; and northeast of the bridge (3) 4 inches deep and 46 feet long x 64 feet wide, were adequately inspected regularly and as necessary to maintain a safe condition for powered industrial vehicle operators carrying empty shipping containers weighing approximately 8,000 lbs. in the depot yard.

29 CFR 1910.22(d)(2): Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired; and a.) On or about August 23, 2022, hazardous conditions such as 4" deep potholes located in the depot yard were not guarded to prevent employees from using the walking working surface until the hazard was corrected in that employees were operating powered industrial vehicles carrying empty shipping containers weighing approximately 8,000 lbs. over the potholes exposing employees to tip over conditions.

29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a.) On or about August 23, 2022, the aisles in the depot yard were not in good repair in that, potholes created a hazard for powered industrial vehicles traveling with loads of empty shipping containers weighing approximately 8,000 lbs. on uneven ground surfaces.
