29 CFR 1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1. Employees were exposed to silica hazards. Employees engaged in Charlie's car wash construction activities, dry cutting on concrete blocks, were exposed to silica hazards. The employer failed to implement engineering and work practice controls as outlined in Table 1 to reduce employee exposure to silica dust.

29 CFR 1926.1153(g)(1):The employer did not establish and implement a written exposure control plan: Employees were exposed to silica hazards. This was most recently documented on August 18, 2022, at 7240 Shawnee Mission Parkway Overland Park, Kansas. Employees engaged in Charlie's Car Wash construction activities, dry cutting on concrete blocks, were exposed to silica hazards in that the employer failed to develop and implement a written silica exposure control plan.
