29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Giron Roofing and Home Exteriors, LLC at 4300 South Technology Drive, Sioux Falls, SD  57106: On or about and at times prior to September 6, 2022, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a commercial building without the use of a fall protection system. This condition exposed employees to falls greater than six feet and training hazards.

29 CFR 1926.501(b)(10):  Each employee engaged in roofing activities on high-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail systems, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system:  (a)Giron Roofing and Home Exteriors, LLC at 4300 South Technology Drive, Sioux Falls, SD  57106: On or about and at times prior to September 6, 2022, the employer did not ensure that employees were protected from falls in that employees were conducting roofing operations on a commercial property without the use of a fall protection system. This condition exposed employees to a fall hazards greater than six feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  (a)Giron Roofing and Home Exteriors, LLC at 4300 South Technology Drive, Sioux Falls, SD  57106: On or about and at times prior to September 6, 2022, the employer did not ensure that employees were properly trained on the use of fall protection systems prior to being exposed to the fall hazards while working on a commercial roof.  This condition exposed employees to fall hazard greater than six feet.
