29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) At 9058 Church Street Semmes, AL (Elevator Shaft/2nd Floor Area - Building 2): On or about August 31, 2022, the employer exposed his employees to fall hazards, in that fall protection was not utilized by employees performing masonry activities up to approximately twelve feet (12') from the ground below. The Hamilton Masonry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1331853, citation number 1, item number 2 and was affirmed as a final order on November 23, 2018, with respect to a workplace located at 4301 Bemiss Road, Valdosta, GA 31605.

29 CFR 1926.59: As referenced by 1910.1200(e)(1), at this job site, the employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, for employees exposed to hazardous chemicals at the jobsite: a) At 9058 Church Street Semmes, AL (Elevator Shaft/2nd Floor Area - Building 2): On or about August 31, 2022, the employer exposed his employees to chemical hazards, in that the employer did not develop, implement or train employees on a written hazard communication program to assist employees using hazardous chemicals such as but not limited to Masonry Cement, Portland cement / Silicate, Limestone, Quartz, Silica, and crystalline (quartz) during masonry activities. The Hamilton Masonry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.59: As referenced by 1910.1200(e)(1)), which was contained in OSHA inspection number 1464068, citation number 1, item number 1 and was affirmed as a final order on June 01, 2020, with respect to a workplace located at 2940 Mill Run Road, Owens Cross Roads, AL 35763.
