29 CFR 1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a.) 5729 Brush Valley Road, Rebersburg PA - Company Wide - Employees were using chemicals including, but not limited to, petroleum-based products and paints. The employer did not develop, implement, or maintain a workplace written hazard communication program therefore exposing employees to hazardous chemicals, on or about September 8, 2022. b.) 5729 Brush Valley Road, Rebersburg, PA - Company Wide - Employees were using chemicals including, but not limited to, petroleum-based products and paints. The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet(s); therefore, exposing employees to chemical hazards, on or about September 8, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) 5729 Brush Valley Road, Rebersburg, PA - Pallet Wood Shop - On or about September 8, 2022, the employer did not institute a continuing and effective hearing conservation program when employees' nose exposure exceeded an 8 hour time weighted average sound level of 85 dBA. A) An employee working within the pallet processing area was exposed to noise at a level of 65.1% of the allowable limit during a 481 minute sampling period on September 8, 2022; exposure calculations included a zero increment for the 30 minutes not sampled. This exposure is equivalent to a sound level of 86.9 dBA for the dose and time of the employee exposure. B) An employee working within the pallet processing area was exposed to noise at a level of 291.9% of the allowable limit during a 479 minute sampling period on September 8, 2022; exposure calculations included a zero increment for the 30 minutes not sampled. This exposure is equivalent to a sound level of 97.7 dBA for the dose and time of the employee exposure. C) An employee working within the pallet processing area was exposed to noise at a level of 194% of the allowable limit during a 471 minute sampling period on September 8, 2022; exposure calculations included a zero increment for the 30 minutes not sampled. This exposure is equivalent to a sound level of 94.7 dBA for the dose and time of the employee exposure. D) An employee working within the pallet processing area was exposed to noise at a level of 291.9% of the allowable limit during a 479 minute sampling period on September 8, 2022; exposure calculations included a zero increment for the 30 minutes not sampled. This exposure is equivalent to a sound level of 97.7 dBA for the dose and time of the employee exposure. Abatement certification required within 10 days after abatement date.
