1910.146(c)(1) The employer shall evaluate the workplace to determine if any spaces are permit-required confined spaces. NOTE: Proper application of the decision flow chart in Appendix A to section 1910.146 would facilitate compliance with this requirement. 29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces and did not comply with 29 CFR 1910.146(c)(1): Tanks #128 and #129: Employer did not evaluate the atmospheric hazards in the testing/sampling/thieving area and did not take effective measures to prevent its employees from entering a designated permit space.
