29 CFR 1926.602(c)(1)(viii)(A):  The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:  a) Jobsite, Northwest Corner of PA-56 and Elm Street, Seward, PA 15954:  On or about July 17, 2022, an employee was standing on a pallet that was lifted off the ground by the forks of a JLG brand telescopic forklift.  The telescopic forklift was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks.  The employee was exposed to a fall hazard of approximately 10 feet to the ground below.

29 CFR  1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l) and as referenced by the note contained in 1926.602(d):  a)  Jobsite, Northwest Corner of PA-56 and Elm Street, Seward, PA 15954:  On or about July 17, 2022, the employer did not certify that each employee who operated a JLG brand telescopic forklift had been trained and evaluated as required by paragraph 29 CFR 1910.178(l) and as referenced by the note contained in 1926.602(d).

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a)  Jobsite, Northwest Corner of PA-56 and Elm Street, Seward, PA 15954:  On or about July 18, 2022, the employer did not ensure that each employee working on the roof of the building were protected from falling by a guardrail system, safety net system, or personal fall arrest system.  The employees were exposed to a fall hazard of approximately 20 feet to the ground below.
