29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Ballymore Company, Inc. located at 501 Gunnard Carlson Drive, Coatesville PA, 19320: The employer did not administer a continuing, effective hearing conservation program for employees performing spray-painting and coating activities and exposed to continuous noise levels equivalent to 67% of the allowable 50% dose for an 8 hour time-weighted average (TWA). An employee conducting spray-painting and coating activities was exposed to noise levels equivalent to an 8 hour TWA of 87.1 dBA, exceeding the OSHA Action Level of 85.0 dBA for an 8 hour TWA. The sampling time was 467 minutes. Zero exposures were assumed for all unsampled time periods.  Violation occurred on January 13, 2023.

An employee conducting spray-painting and coating activities was exposed to noise levels equivalent to an 8 hour TWA of 87.1 dBA, exceeding the OSHA Action Level of 85.0 dBA for an 8 hour TWA. 29 CFR  1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of Total Dust (particulates not otherwise regulated) listed in Table Z-1 in excess of 15 milligrams per cubic meter as an 8-hour Time Weighted Average (TWA) concentration:  a) Ballymore Company, Inc. located at 501 Gunnard Carlson Drive, Coatesville PA, 19320: The employer did not protect employees from airborne concentrations of Total Dust (particulates not otherwise regulated) listed in Table Z-1 in excess of 15 milligrams per cubic meter as an 8-hour Time Weighted Average (TWA) concentration. Employees performed powder spray coating activities inside spray booths, and were exposed to Total Dust (particulates not otherwise regulated) during an 8-hour workday of 27.51 milligrams per cubic meter and 22.450 milligrams per cubic meter as an 8-hour Time Weighted Average (TWA). Exposure is 1.838 and 1.497 times the OSHA Permissible Exposure Limit (PEL) of 15 milligrams per cubic meter.  Violation occurred on January 13, 2023.

29 CFR  1910.1000(e):Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):  a) Ballymore Company, Inc. located at 501 Gunnard Carlson Drive, Coatesville PA, 19320: Engineering controls were not implemented to achieve compliance when two employees were overexposed to Total Dust (particulates not otherwise regulated) while performing spray coating and spray-painting activities. Employees were exposed to Total Dust (particulates not otherwise regulated) during an 8-hour workday of 27.51 milligrams per cubic meter and 22.450 milligrams per cubic meter as an 8-hour Time Weighted Average (TWA) which is 1.838 and 1.497 times the OSHA Permissible Exposure Limit (PEL) of 15 milligrams per cubic meter.  Violation occurred on January 13, 2023.
