OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. At or near 143 Watchung Ave., Chatham, NJ - Street The employer did not ensure that employees were free of workplace hazards or serious injury in that an employee operating a Komatsu, WA270 Loader/Tractor and traveling on an open public roadway allowed another employee to ride on the steps of the equipment during regular operations. An employee was observed riding as a passenger on the side entry steps/ladder of the equipment and was exposed to crushing and struck-by hazards from a fall from the equipment. Violation observed on or about September 15, 2022

At or near 143 Watchung Ave., Chatham, NJ - Street The employer did not ensure that employees operating heavy construction utilized seatbelts. An employee engaged in the repair/replacement of catch basis on a city road operated a Komatsu WA270 Loader and did not utilize the manufacturers installed seatbelt. Violation observed on or about September 15, 2022
