29 CFR  1926.503(a)(1): The employer did not provide fall protection training to those employees who might be exposed to a fall hazard:  a.  the employer fails to ensure employees exposed to fall hazards are provided fall protection training  as demonstrated on or about 09/14/2022, at  Lot #6 Cyrus Cove Drive, Hoover, AL, where employees placing shingles were not trained to recognize the fall hazards.  To abate this hazard, the employer must provide fall protection training to employees exposed to fall hazards.

29 CFR  1926.1060(a)(1): The employer did not provide a training program for each employee using ladders as necessary, enabling each employee to recognize hazards related to ladders and the procedures to be followed to minimize these hazards:  a.  The employer fails to ensure employees using ladders are trained as demonstrated on or about 09/14/2022, at Lot #6 Cyrus Cove Drive, Hoover, AL, where employees utilizing an aluminum extension ladder to access a roof were unaware of the hazards associated with not using the ladder properly.  To abate this hazard, the employer must ensure employees using ladders are provided a training program.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toe-boards, safety net systems or personal fall arrest systems:  a.  The employer fails to ensure roofers laying shingles exposed to fall hazards of approximately 19 feet to the ground below are protected as demonstrated on or about 09/14/2022, at Lot #6 Cyrus Cove Drive, Hoover, AL, where employees were not protected from fall hazards while working on a steep-sloped (6:12) roofing system.  Rodolfo Marquez was previously cited for a second repeat-serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1444230, citation number 1, item number 2 and was affirmed as a final order on 02/05/2020, with respect to a workplace located at 1012 Mountain Laurel, (Lot #79), Moody, AL.  Rodolfo Marquez was previously cited for a first repeat-serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1385759, citation number 2, item number 1 and was affirmed as a final order on 07/10/2019, with respect to a workplace located at 7975 Furnace Drive, (Lot #3003), McCalla, AL.

To abate this hazard, the employer must ensure eye protection is worn.   Rodolfo Marquez was previously cited for a first repeat-serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1444230, citation number 1, item number 1 and was affirmed as a final order 02/05/2020, with respect to a workplace located at 1012 Mountain Laurel Circle, (Lot #79), Moody, AL.  Rodolfo Marquez was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1385759, citation number 1, item number 1 and was affirmed as a final order on 07/10/2019, with respect to a workplace located at 7975 Furnace Drive, (Lot #3003), McCalla, AL.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a ridged support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the ladder:  a.  The employer fails to ensure ladders used for access extend 3 feet above the upper landing surface as demonstrated on or about 09/14/2022, at Lot #6 Cyrus Cove Drive, Hoover, AL, when the  Werner aluminum extension ladder used by employees did not extend 3 feet or more above the landing surface exposing employees to fall hazards of approximately 19 feet.  To abate this hazard, the employer must ensure ladders are extended at least 3 feet above the upper landing surface.  b.  The employer fails to ensure ladders used for access extend 3 feet above the upper landing surface as demonstrated on or about 09/14/2022, at Lot #6 Cyrus Cove Drive, Hoover, AL, when the Werner aluminum extension ladder used by employees did not extend 3 feet or  above the landing surface exposing employees to fall hazards of approximately 10 feet.  To abate this hazard, the employer must ensure ladders are extended at least 3 feet above the upper landing surface.  Rodolfo Marquez was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 130377, citation number 1, item number 2 and was affirmed as a final order on 05/14/2018, with respect to a workplace located at 5531 Sienna Circle, Montgomery, AL.
