29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a.  On or about September 16, 2022, at the above addressed jobsite,  an employee using a pneumatic nail gun did not wear safety glasses, thereby exposing the employee to the hazards associated with eye injuries.

The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head.  a.  On or about September 16, 2022, at the above addressed jobsite, employees conducting residential roofing operations were not wearing personal fall arrest system (PFAS)  with the attachment point at the employee's back, at a fall height for nine (9) foot six (6) inches above the ground, thereby exposing the employees to the hazards associated with falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.  On or about September 16, 2022, at the above addressed jobsite,  employees performing residential roofing operations, approximately (9) feet nine (9) inches above the ground, was not protected from falls, thereby exposing the employees to fall hazards.  b.   On or about September 16, 2022, at the above addressed jobsite,  an employee performing residential roofing operations, approximately (9) feet six (6) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  Ar Discount Construction Inc. was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13) or its equivalent, which was contained in OSHA inspection number 1278798, citation number 1 item number 1 and was affirmed as a final order on January 23, 2020, with respect to a workplace located at 1425-1435 S. Neltor Blvd. West Chicago, IL. 60185.
